No products or parts and packaging from any products should be placed in the mouth. Children should be instructed about safe use of any product that is place around the neck such as lanyards or necklaces.

ALWAYS apply caution, common sense, and provide adequate instruction to children before distributing.

Privacy Policy

The primary purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customized experience. This allows BoostPromotions to provide services and features that most likely meet your needs, and to customize our service to make your experience safer and easier. BoostPromotions collects personal information about you that is necessary for achieving this purpose.

If you choose to use BoostPromotions services, we require you to provide contact and identity information, billing information, shipping information and other personal information as indicated on the forms on this site. As required by law under the Fair Credit Billing Act, your credit card issuer must limit your liability to $50 in the extremely rare case of confirmed credit card fraud. When you place an order on BoostPromotions, a Federally Insured and Accredited Banking Institution manages the credit card processing.

Use of Information

BoostPromotions uses your personal information to bill you for your purchases, as well as for delivery.

BoostPromotions will under no circumstances share your email address with 3rd party companies. Information about the activity of visitors to this site is tracked automatically when you visit our site or sign in. We use this information for internal review in aggregate and to improve your shopping experience. Monitoring customer traffic patterns and website usage helps us improve the design and layout of the online store. Based on your online experience, we may send you recommendations for items that may interest you. These communications will only come from BoostPromotions. We may also notify you of important functionality changes to the website, services, or special online offers we think you'll find valuable. Your information is stored on BoostPromotions servers located in the United States. Typographical Errors

In the event that a BoostPromotions product is mistakenly listed at an incorrect price, BoostPromotions reserves the right to refuse or cancel any orders placed for product listed at the incorrect price.

BoostPromotions reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, BoostPromotions shall issue a credit to your credit card account in the amount of the incorrect price.

Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by BoostPromotions without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Use of Site

Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a BoostPromotions or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You agree to indemnify, defend, and hold harmless BoostPromotions, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

Third-Party Links

In an attempt to provide increased value to our visitors, BoostPromotions may link to sites operated by third parties. However, even if the third party is affiliated with BoostPromotions, BoostPromotions has no control over these linked sites, all of which have separate privacy and data collection practices, independent of BoostPromotions. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, BoostPromotions seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).

Returns, Credits, and Shipping

We offer a thirty (30) day money back guarantee on most items returned in new, unused condition, and returned in their original packaging providing the item is not a custom item or personalized item or branded in any way.

We do not refund return postage or shipping postage. We will promptly credit the original credit card, or issue a BoostPromotions store credit.

For oversized items there is a 15% re-stocking fee, which if applicable, will be clearly displayed on the product details page prior to purchase. If you are not sure, please call us prior to ordering an item.

We do not pay for return postage, or refund the original postage. Returned items must be returned using a Return Merchandise Authorization (RMA). Returned items sent COD or without postage will be refused and returned to the sender.

If you refuse delivery of your package from our shipping carriers, or if you have given an incorrect address, or if our shipping carrier was unable to deliver the package because noone was at the mailing address or the business was closed, you will be responsible for all shipping charges associated with sending and returning the package to BoostPromotions.

ASSEMBLY & PRODUCT CONDITION

Unless specifically requested in writing and paid for as a separate line item, printed Swag Tags and all other tags will arrive in individually sealed bags. If the tags have been ordered with lanyards, chains or any other accessory, the accessories will be packaged separately from the tags and will require assembly once received. Labor for assembly is the responsibility of the Buyer.

Tags may have loose divots that were not completely cut away from the tag during the die cutting process. Divots can be pushed away with the use of a pen before being placed on a chain, lanyard or accessory.

If Buyer does not want to be responsible for assembly or removing random divots, they may request a price from BoostPromotions and a quote will be provided above and beyond the cost of the product.

The backside of all tags will be printed with our company website address unless the customer has paid for custom printing on the reverse side.

CUSTOMIZED PRODUCT

Payments

Payment in full must be received prior to commencement of work. Payment can be made by credit card.

Purchase Orders

Purchase orders are only accepted from federally funded school districts. Payment on Purchase orders is due upon receipt of goods or no later than 5 days following proof of shipment.

PO Late Payment

In the event that payment is not received within 14 days of the receipt of the receipt of product or 19 days from proof of shipment, Buyer agrees to pay a handling /collection fee of 49.00 plus applicable interest and if necessary all other collection or legal fees associated with the same.

Schedule

Schedules for CUSTOM/BRANDED product availability are stipulated in each product section and are subject to terms and conditions represented below.

Deadlines

Regardless of discussions concerning deadlines or dates that products are needed; the timeframe for production is always determined by receipt of payment and final acceptance of proof approvals.

If payment or "proof Approval" is delayed, The product will be delayed.

On-time delivery is subject to timely responses for proof approvals, notice of low resolution or inadequate artwork or notice of clarifications to complete the job. Timely replies are interpreted as 2 working hours from time of notice.

Delays as a result of late payments, proof acceptance, low res images or delays in requests for information will subsequently result in a FAILURE TO MEET DEADLINES. Whether stipulated or not. Buyer agrees that any failure to meed a deadline for reasons listed above. will not be cause for cancelation of order or a request for discount.

Shipping

Buyer is responsible for all shipping costs associated with the delivery of product. Buyer is responsible for making appropriate shipping choices to warrant on-time delivery.

BoostPromotions does not charge a handling fee to process shipments. Buyer is only expected to pay for the actual shipping cost as charged by UPS or USPS.

Buyer will need to stipulate shipping instructions in writing by email. UPS & USPS pickup from BoostPromotions at 2 PM each day.

Time sensitive Deliveries.

Often times, when orders are time sensitive, we are asked when an order will arrive. We have control over when an order is ready to be shipped, but we do not have control over the actual delivery date unless the Buyer pays for guaranteed shipping of 1, 2 or 3 days.

Flat Rate shipping averages

We are able to state how long it will takes for Flat rate packages to arrive in a general sense, but Buyer must bear in mind that these are statements based on experience in most cases, but is not a guarantee. When shipping flat rate, USPS has a window of 3 to 5 days for the delivery. If anyone at BoostPromotions indicates that a package most often will arrive within three days and it ends up being 4 or 5 days, the Buyer agrees to accept this risk and possible disappointment. We make every effort to help our customers save money where they can, but it is our recommendation that if a package must absolutely be delivered on a specific date, that they Buyer pay the extra money for guaranteed shipment.

Required Signature Option

It is recommended that the buyer request (SIGNATURE REQUIRED) on deliveries over 50.00 for their protection. Delivery to Commercial locations are generally more secure, but for home deliveries, If the Buyer chooses to ship without a required signature, the postman will leave the package at the front door which is susceptible to theft.

Insurance Option

It is also recommended that the Buyer request and pay for insurance in the event the delivery is lost or damaged during shipment.

Shipping Instructions

It is the Buyers responsibility to inform BoostPromotions in writing of their desired shipping and decisions about other shipping options.

Online Tracking

If a package has been shipped but not received, Buyer may call BoostPromotions and we will check the tracking online. If the tracking shows that the package was delivered but was not received, an investigation will be initiated by BoostPromotions on your behalf with USPS.

Lost Packages

Shipping investigations can take up to 48 hours before USPS is able to provide additional information.

GPS Coordinates Stamp

All shipping labels are scanned by the Postman at the time they are delivered to substantiate the actual GPS coordinates of the delivery. The first part of the investigation will be for USPS to download the GPS records to verify that the package was delivered to the address represented on the shipping label.

If the package was shipped to the correct address as represented by GPS coordinates, the Buyer and position of USPS will be that the package was shipped successfully.

If the package is not found, it is considered lost or stolen in which case the buyer accepts full responsibility for the loss unless they will issue a replacement order.

ARTWORK SUBMISSIONS

Artwork submitted by the buyer will not be pre-flighted or viewed prior to the receipt of a signed agreement and payment. Silk Screen

Artwork Templates

Buyer may request BoostPromotions to email an adobe Photoshop layered template once an order has been completed online.

File Types

Buyer may submit artwork in the following formats: jpg, tiff, pdf, psd, ai. All images mst be 300 dpi for offset print quality. Artwork must be submitted or constructed as a CMYK file.

Fonts

If Buyer provides layered files, they must also provide the fonts used in the creation of the files. Failure to do so may result in a substituded font that is not the same as Buyers submission.

Font Sizes

Artwork should not have fonts smaller than 8 point for legibility and clear printing without ghosting. Avoid using drop shadows or other layer effects on text that is smaller than 10 points.

Die Cutting Designs submitted for printing that will be DIE CUT must have a bleed area of 1/8” beyond the cut line. Design should avoid straight edges that are within ¼“ of die cut edges. Die cutting will vary by as much as 1/16” from side to side. Design should not have any printing within 1/8” of any die cut edge.

Color Matching

Online images, Email images, Inkjet prints, Laser prints and digital proofs are not adequate for color matching print work. Each computer screen may vary substantially from another as a result of individual calibration and settings.

If color matching is required, Buyer will need to mail actual samples of artwork to BoostPromotions and specify in writing the desired PANTONE color numbers.

A Pantone color guide swatch book may be ordered at 800 892 8805.

Orders that involve color matching are not able to be run or ganged up with other orders which results in additional expense and additional time to complete the order. For additional questions about color matching, please contact us at 909 231 5837

If Buyer is ordering multiple products or different kinds of products it must be understood that the printing process is different from one medium to another and color may not be the same from one fabric to another or from plastic to paper etc. BoostPromotions cannot guarantee color matching between one product to another for branded product orders.

LEGAL EASE

Indemnification

The Buyer shall indemnify and hold harmless BoostPromotions from any and all loss, cost, expense, and damages on account of any and all materials of claim demands, actions and proceeding that may be instituted against BoostPromotions on grounds alleging that the said printing violates any copyright or any proprietary right of any person, or that it contains any material that is liberal, slanderous, or scandalous, or invades any person’s right to privacy or other personal rights. The Buyer agrees to, at the Buyer ‘s own expense, promptly defend and continue the defense of any such claim, demand, action, or proceeding that may be brought against the BoostPromotions, provided that the BoostPromotions shall promptly notify the Buyer with respect thereto, and provided further that the BoostPromotions shall give to the Buyer such reasonable time as the agencies of the situation may permit in which to undertake and continue the defense thereof.

Warranty Disclaimer

This site and the materials and products on this site are provided "as is" and without warranties of any kind, whether express or implied. To the fullest extent permissible pursuant to applicable law, BoostPromotions. disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement.

BoostPromotions does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components.

BoostPromotions does not make any warrantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.

Limitation of Liability

BoostPromotions shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if BoostPromotions has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Errors

BoostPromotions will be responsible for all defects in the work to be performed as a result of his own work. In the event that the Buyer grants a reprint of the work due to inferior production, which is determined to be BoostPromotions’s responsibility, BoostPromotions’s liability shall be limited to the actual cost of goods.

BoostPromotions will make no adjustment or reimbursement on the basis of revenue lost, nor will BoostPromotions effect reimbursement where placement or unusual requirements exceed the limitations of the printing process used.

Claims

Any claim for defective or damaged goods or for shortage must be made by the Buyer within 7 days of receipt of goods or 12 days following date of shipping.

Orders are individually counted for quantity accuracy. Buyer is encouraged to count contents of each box and check for quality issues upon delivery. Failure to make such claim at the time of delivery shall constitute an irrevocable acceptance of the goods.

Shipping Damage

Transportation claims must be made by the Buyer directly against the carrier. Take pictures before signing for or accepting the pallets or boxes from the shipper.

Make the driver sign for any damage. Buyer agrees to pursue all shipping claims directly with the shipping company without prejudice to the BoostPromotions.

Arbitration

Any controversy of claim arising out of or relating to this contract or the breech thereof may be settled by arbitration in accordance with the Commercial Rules of the American Arbitration Association and judgment upon the award rendered by the Arbitrator may be entered in any court having jurisdiction thereof.

Personal Guarantee

Buyer agrees to personally guarantee the payment and possible additional expenses associated with this job. Personal guarantee may be acted upon in the event of payment default by the above mentioned individual or company.

Defaults

Are interpreted as failure to pay any invoice per the terms of this agreement on accounts with payment terms or for any payment that is stopped as a result of chargeback or stopped by order to any bank or payment institution.

Amendments

This Agreement and the schedules now or hereafter a part hereof may not be amended or altered in any manner unless such amendment or alteration is in writing and signed on behalf of both parties.

Entire Agreement

This agreement together with generated quotes/invoices and schedules shall constitute the entire Agreement between the parties hereto.

When so executed by initiation of a purchase, shall be binding on the respective parties and their respective heirs, executors, administrators, legal representatives, successors, and assigns. Nothing expressed or implied by any party of BoostPromotions shall be biding unless it is in writing.

Governing Law

This agreement shall be governed in accordance with the laws of Utah County in the State of Utah.

Authorized Approval

The act of purchasing from this site constitutes acceptance of the terms and conditions between the Buyer and BoostPromotions.

The individual accepting and entering into this online agreement warrants that they are authorized, by nature of their position, to bind themselves as well as the company and principles of the company, to the terms and conditions here stipulated.
